Section 1: Psychiatric care procedure

The provisions of Sections 1 and 2 of Chapter I, Chapters II and III of Title I and Chapters II and III of Title II of Book II of this Part shall apply in New Caledonia and French Polynesia, subject to the provisions of this Section.

For the application of Book II : 1° The powers vested in the Prefect are exercised by the representative of the State; 2° The powers vested in the judicial court, its president or its registry are vested in the court of first instance, its president or its registry; 3° References to the departmental psychiatric care commission are replaced by references to the psychiatric care commission; 4° References to an establishment…

For the application of article R. 3222-6: 1° The words: “the director of the regional health agency” are replaced by the words: “the locally competent health authority”; 2° In the last paragraph, the words “Minister for Health” are replaced by the words “State representative”.

For the application of article R. 3223-1, the words: “In each département” are replaced by the words: “In New Caledonia and French Polynesia”.

For the application of the second paragraph of article R. 3223-7, the words: “by the regional health agency” are replaced by the words: “by the services of the State representative” and the second sentence is deleted.

For the application of article R. 3223-10, the words: “order of the ministers responsible for the budget and health” are replaced by the words: “order of the State representative”.

For the application of 1° of article R. 3223-11, the words: “order of the Minister for Health” are replaced by the words: “order of the State representative”.
