Foreign nationals holding a residence permit or visa for a stay of more than three months, as referred to in 11° of article R. 5221-2 and bearing the word “student”, are authorised to work in an employed capacity on an ancillary basis, up to a maximum annual working time of 964 hours. The declaration by name provided for in article L. 5221-9 is sent by the employer to the prefect of the département in which the employing establishment has its registered office or the individual employer resides at least two working days before the effective date of recruitment. This formality is carried out by any means that allows the receipt of the declaration to be dated with certainty.
