Section 3: Prohibition on offering advantages

It is prohibited for the persons mentioned in article L. 1453-4 to receive benefits in cash or in kind, in any form whatsoever, directly or indirectly, offered or procured by the persons mentioned in article L. 1453-5.

The prohibition provided for in article L. 1453-3 is applicable : 1° To persons practising a health profession regulated by this code, to osteopaths and chiropractors mentioned inarticle 75 of law no. 2002-303 of 4 March 2002 relating to patients’ rights and the quality of the health system and to psychotherapists mentioned inarticle 52 of law no. 2004-806 of 9 August 2004 relating to public health policy ; 2° Students…

Offering or promising benefits in cash or in kind, in any form whatsoever, directly or indirectly, to persons mentioned in article L. 1453-4 is prohibited for any person providing health services, producing or marketing products covered by compulsory social security schemes or products mentioned in II of article L. 5311-1, with the exception of those mentioned in 14°, 15° and 17°.

The following do not constitute benefits within the meaning of this chapter 1° Remuneration, compensation and expenses for activities provided for in a contract of employment or a contract of practice, provided that the purpose of this contract is the direct and exclusive practice of one of the professions provided for in article L. 1453-4; 2° Proceeds from the exploitation or transfer of intellectual property rights relating to a health…
