Section 1: Operating conditions.

The persons referred to in the first paragraph of Article L. 4644-1 are appointed after consultation of the social and economic committee, if any. They are given the time and resources required to carry out their duties. They may not be discriminated against on the grounds of their preventive activities.

The intervention of the occupational risk prevention consultant registered under the conditions laid down in section 2 is subject to the conclusion of an agreement between the latter and the employer or the president of the inter-company occupational health service. When the employer uses the services of a registered occupational risk prevention consultant or the prevention bodies mentioned in article L. 4644-1, he informs his occupational health service of this intervention and of the results of the studies carried out in this context.

The agreement referred to in article R. 4644-2 may not include clauses authorising the registered occupational risk prevention practitioner to perform procedures falling within the remit of the occupational physician.

The registered occupational risk prevention adviser has access to all non-nominative documents required by this part. This right of access is exercised under conditions which guarantee the confidential nature of the data and the protection of the information referred to in Article R. 4624-9.
