Subsection 1: Approvals

Each prevention and occupational health service is approved by the Regional Director for the Economy, Employment, Labour and Solidarity, after consulting the occupational health inspector. The Regional Director may authorise an establishment or company located within the jurisdiction of another region to be attached to the occupational health and prevention service which he has approved, subject to the agreement of the Regional Director with geographical jurisdiction.

Approval may only be refused on the grounds of non-compliance with the requirements of this Title, in particular those of the national approval specifications defined in Article D. 4622-49-1. Reasons shall be given for any refusal of approval.

Each Regional Directorate for the Economy, Employment, Labour and Solidarity presents to the Regional Occupational Health and Safety Committee, for its opinion, the procedures for applying at regional level the national specifications for approval provided for in Article D. 4622-49-1.

Applications for approval or renewal of approval must be accompanied by a dossier, the details of which are set by order of the Minister for Employment. Applications for renewal of approval must be submitted at least four months before the current approval expires.

When the Regional Director of the Economy, Employment, Labour and Solidarity notes that the operating conditions of the occupational health and prevention service do not comply with the requirements of this Title, and in particular those of the national specifications for approval, he may, after obtaining the opinion of the occupational health inspector: 1° In the event of an application for approval or renewal, issue an approval for a maximum…

Silence on an application for approval or renewal of approval for more than four months is equivalent to an approval decision. Silence kept for more than four months by the Minister in charge of labour in the event of a hierarchical appeal against a decision relating to approval shall be deemed to constitute an approval decision.
