In the absence of adaptation, references made by the provisions of this code applicable in Saint-Pierre-et-Miquelon to provisions that do not apply there are replaced by references to provisions with the same purpose that may be applicable locally.

For the application of this Code in Saint-Pierre-et-Miquelon, the terms listed below are replaced as follows: 1° “tribunal judiciaire” (judicial court) by “tribunal de première instance” (court of first instance); 2° “Cour d’appel” (court of appeal) by “tribunal supérieur d’appel” (higher court of appeal); 3° “Tribunal de commerce” (commercial court) by “tribunal de première instance statuant en matière commerciale” (court of first instance ruling on commercial matters); 4° “Premier président…

In Saint-Pierre-et-Miquelon, the functions assigned to bailiffs by this code are carried out by the persons listed in article 183 of decree no. 548 of 2 November 1942, as amended, on the judicial organisation of the islands of Saint-Pierre and Miquelon.

For the application of articles R. 121-7 and R. 212-1 in Saint-Pierre-et-Miquelon, the parties may be assisted or represented either by the persons mentioned inArticle L. 3252-11 of the Labour Code or in Article R. 121-7, or by an approved person, who is exempt from producing a power of attorney.

For the application of article R. 121-7, the overseas collectivity of Saint-Pierre-et-Miquelon may be represented or assisted before the judge by a civil servant or agent of its administration.

For the application of Article R. 412-2 in Saint-Pierre-et-Miquelon, the word: “départemental” and the words: “la loi n° 90-449 du 31 mai 1990 visant à la mise en œuvre du droit au logement” are replaced respectively by the word: “territorial” and the words: “la réglementation le cas échéant applicable localement”.
