Subject to the provisions adopted in application of Article L. 6147-1 and Article L. 6143-4, the State control provided for in Article L. 6141-1 is exercised in budgetary matters by the Director General of the Regional Health Agency.

The budget and the proposed tariffs used as a basis for patient contributions for medical care and rehabilitation activities are set by the Director and sent to the Director General of the Regional Health Agency no later than 1st January of the year to which they relate. The health care organisation shall make available to the Director General of the Regional Health Agency the documents and information necessary for the exercise of its control. Requests for these documents, other than those provided for in article R. 6145-19, do not suspend the time limits provided for in article R. 6145-29.

Where the Director General of the Regional Health Agency objects to the budget, he shall set a time limit, not exceeding thirty days from notification of the objection, within which the director of the institution shall draw up a new budget. This new budget is sent without delay to the Director General of the Regional Health Agency for approval.

Subject to the provisions of the second paragraph of Article L. 6145-1, the Director General of the Regional Health Agency may comment on the draft statement of projected income and expenditure without expressly refusing to approve it.

The provisions of the first paragraph of Article L. 6145-2 apply when the statement of estimated revenue and expenditure has not been drawn up by the Director by 1st January of the year to which it relates.

Where the budget has not yet been implemented, and subject to the provisions of article L. 6145-2, revenue and expenditure transactions shall be carried out temporarily on the basis of the implemented statement of estimates for the previous financial year.

The charges for hospital services mentioned in 2° of article L. 162-22-8-2, in article L. 162-22-10 and in 1° of I of article L. 162-23-4 of the Social Security Code are invoiced in accordance with the conditions in force at the end of the patient’s stay.
