The training courses eligible for the personal training account are those mentioned in article L. 6323-6.
When the training courses financed under the personal training account are taken in whole or in part during working hours, the employee applies for leave of absence from the employer, who will notify the employee of its response within a period determined by decree. If the employer does not respond, this is deemed to be acceptance.
All employees can use the rights in their personal training account to help finance a training course leading to a qualification, designed to enable them to change jobs or professions as part of a career transition project. The duration of the professional transition project corresponds to the duration of the training course.
The duration of the professional transition project cannot be deducted from the annual paid leave. This project is treated as a period of work : 1° For the determination of the rights of the persons concerned with regard to annual paid leave ; 2° With regard to the rights that the employee derives from his seniority in the company.
The employee benefiting from the professional transition project is entitled to a minimum remuneration determined by decree. In companies with fifty or more employees, the remuneration due to the beneficiary of the professional transition project is paid by the employer, who is reimbursed by the regional inter-professional joint commission mentioned in article L. 6323-17-6. An inter-professional joint committee is approved in each region by the administrative authority to provide financial support for the professional transition project referred to in article L. 6323-17-1.
