Any substantial modification made by a cinema operator to an approved formula is subject to an amending approval issued for the remaining period of validity of the initial approval.

Any modification relating to: 1° The commitments of the operator issuing the approved formula mentioned in article L. 212-28; 2° The association contracts concluded by the exhibitor issuing the approved package with the exhibitors associated with this package; 3° The list of cinemas in which the approved package is accepted; 4° The price, payment methods, duration, cancellation of the subscription and, in general, the conditions of use of the package…

The reference price mentioned in article L. 212-28, to which the exhibitor issuing the formula commits, serves as the basis for remuneration of distributors with whom it concludes contracts for the granting of cinematographic representation rights, as well as for remuneration of rights holders. The reference price mentioned in article L. 212-30 may vary for each associated operator. It is determined by taking into account the range of reduced fares charged by each of these operators. This reference price may be indexed.

Where applicable, the operator issuing the form informs the President of the Centre national du cinéma et de l’image animée of the implementation of the indexation mentioned in articles R. 212-47 et R. 212-48.

The thresholds for admissions or receipts in a given catchment area and the thresholds for admissions and receipts at national level, mentioned in article L. 212-30, are assessed by grouping together cinemas which constitute a community of economic interests. In particular, establishments operated by companies controlled directly or indirectly by common partners or shareholders are considered as such.
