In the event of a vacancy, the seat of a full member is filled by the alternate member. In particular, a vacancy is established when the full members cease to hold office or when they no longer meet the conditions required to be eligible for election to the Disciplinary Board.

The supplementary election provided for the appointment of the new substitute pursuant to article L. 4443-3 shall be organised on the proposal of the Disciplinary Board.

The State representative draws up and posts the electoral list. Voters are pharmacists who, on the date of closure of the electoral list provided for in article D. 4443-21, are duly registered with the Association and are not subject to a final and currently enforceable decision prohibiting them from practising or providing services to the socially insured.

The declaration of candidacy is made jointly by the titular candidate and the substitute candidate using a form laid down by order of the representative of the State. The declaration of candidacy shall specify in particular the surnames, first names, personal addresses and business addresses of each of the candidates.

The declaration of candidacy is sent to the State representative by registered letter with acknowledgement of receipt. The application may also be received by the State representative in return for a receipt. A declaration received after the closing date for the submission of candidatures mentioned in article D. 4233-21 is inadmissible.
