Subsection 7: Amount of the surcharge and recovery of the unpaid parking charge

The amount of the surcharge provided for in IV of article L. 2333-87 is set at 20% of the amount of the unpaid parking charge outstanding, but may not be less than €50.

The collection and recovery of the unpaid post-parking charge and its increase are governed by the provisions of article R. 2323-7 of the general code of public property.

The Agence nationale de traitement informatisé des infractions governed by decree no. 2011-348 of 29 March 2011 is the authorising officer responsible for issuing the enforcement order provided for in IV of Article L. 2333-87.

With a view to issuing the enforcement order or cancellation order mentioned in IV of article L. 2333-87, the commune, the public establishment for inter-communal cooperation, the mixed syndicate or the contracting third party shall transmit the following information to the Agence nationale de traitement informatisé des infractions: – the identification and contact details of the commune, the public establishment for inter-municipal cooperation or the mixed syndicate that is the…

The enforcement order and the cancellation order issued by the Agence nationale de traitement informatisé des infractions are sent to the competent public accountant. They mention the identity and address of the person liable for payment, the information listed in article R. 2333-120-17-2 and any other information required for accounting purposes.

The elements required for the information mentioned in article R. 2333-120-17-2 and the technical specifications for their electronic transmission, as well as the elements required for the accounting processing of the securities mentioned in article R. 2333-120-17-3, are specified by order of the Minister for the Interior and the Minister for the Budget.
