Subsection 3: Monitoring of judicial supervision decisions

The monitoring of judicial supervision measures ordered is governed by this code. If the person placed under judicial supervision cannot be found on the territory of the Republic, the liberty and custody judge shall inform the competent authority of the issuing State of the impossibility of supervising the measures ordered.

During the monitoring of supervision measures, the liberty and custody judge may at any time invite the competent authority of the issuing State to provide information as to whether monitoring of the measures is still necessary. Where the liberty and custody judge has forwarded several notices pursuant to the second paragraph of Article 696-86 concerning the same person to the competent authority of the issuing State without the latter having taken a decision to review, withdraw or modify the judicial supervision measures ordered and without an arrest warrant or any other decision having the same effect having been ordered, he or she may invite the competent…

If the competent authority of the issuing State does not take a decision within the period specified by the liberty and custody judge, the latter may decide to terminate the monitoring of the measures ordered.

When the liberty and custody judge is informed that the person concerned has established his lawful and habitual residence in another State, he shall inform the competent authorities of the issuing State without delay and by any means that leaves a written record.
