I. – When it is established that a medical biology laboratory has committed one or more of the offences listed in Article L. 6241-1, the Director General of the Regional Health Agency shall notify the legal representative of the laboratory, by any means that enables receipt to be acknowledged, of the facts of which the laboratory is accused and the penalties incurred, and shall ask it to make known, within…

For the offences mentioned in 19°, 21° and 22° of Article L. 6241-1, when the offender is not a medical biology laboratory, the procedure provided for in I, II and IV of Article R. 6241-1 is applicable.

For the offences mentioned in 4°, 9° and 11° of Article L. 6241-1, the Director General of the Regional Health Agency may order the immediate suspension of the right to practise of the medical biologist, the biologist in charge, the biologist with joint responsibility or the qualified specialist in anatomy and pathological cytology with joint responsibility for the medical biology laboratory. Administrative fines and daily penalty payments imposed pursuant to Article L. 6241-2 are recovered by the accounting officer of the Regional Health Agency and paid to the State.
