Subsection 2: Société de gestion du fonds interprofessionnel de l'accès au droit et à la justice (Management company for the inter-professional fund for access to law and justice)

The legal entity mentioned in the fourth paragraph of Article L. 444-2 responsible for managing the interprofessional fund for access to law and justice is a public limited company whose capital is held by the State. Its corporate name is: “Société de gestion du fonds interprofessionnel de l’accès au droit et à la justice” (SGFIADJ).

The board of directors of the fund management company is made up of five directors appointed under the conditions set out in article L. 225-17, in accordance with the following procedures: 1° One director appointed by the Prime Minister, chosen from among the magistrates of the Cour des Comptes, Chairman of the Board of Directors; 2° Four directors appointed respectively by the Minister of Justice, the Minister of the Interior,…

An advisory committee, called the “Comité consultatif des aides à l’accès au droit et à la justice” (CCAADJ), is set up by the board of directors of the fund management company. At the request of the Board of Directors, the Committee gives its opinion on any matter relating to the administrative, accounting and financial management of the Fund.

The Comité consultatif des aides à l’accès au droit et à la justice comprises eight members: 1° Two university professors, respectively agrégé de droit and agrégé de sciences économiques, co-chairs of the committee; 2° A judicial administrator; 3° A judicial auctioneer; 4° A commercial court clerk; 5° A bailiff; 6° A judicial representative; 7° A notary. The articles of association and internal regulations of the fund management company are approved by a joint order of the Minister of Justice and the Minister for the Budget. The internal regulations of the advisory committee are approved under the same conditions.

A decree specifies the conditions under which the fund management company implements the provisions of this section, in particular for the management of applications and the granting of aid.
