Section 2: Penalties and criminal liability

Smoking in a public place mentioned in article R. 3512-2 outside the area mentioned in article R. 3512-3 is punishable by a third-class fine.

Any person in charge of premises where the ban laid down in article R. 3512-2 applies is liable to a fourth-class fine for : 1° Failing to display the signs provided for in article R. 3512-7; 2° Making available to smokers a location that does not comply with the provisions of articles R. 3512-3 and R. 3512-4; 3° Knowingly encouraging, by any means whatsoever, the violation of the prohibition mentioned…

Smoking in a vehicle in the presence of a minor in disregard of the ban provided for in article L. 3512-9 is punishable by a fourth-class fine.

Selling or offering tobacco products free of charge to a minor in a tobacconist’s, shop or public place in breach of the prohibition set out in article L. 3512-12 is punishable by a fourth-class fine.

Selling or offering vaping products free of charge to minors in tobacco shops or any other business or public place in breach of the prohibition laid down in article L. 3513-5 is punishable by a fourth-class fine.

Vaping in the places mentioned in 1° to 3° of article L. 3513-6 in disregard of the prohibition provided for in the same article is punishable by the fine laid down for 2nd class offences.

Failure by the person in charge of the premises where the prohibition provided for in article L. 3513-6 applies to erect the signs provided for in article R. 3513-3 is punishable by a fine for a 3rd class offence.

For the application of articles R. 3515-5 and R. 3515-6, in the local authorities governed by Article 73 of the Constitution, in Saint-Barthélemy, Saint-Martin and Saint-Pierre-et-Miquelon, the words: “, in tobacco shops,” are deleted.
