Subsection 2: Time savings account.

Medical, pharmaceutical and odontological staff, governed by the provisions of sections 1 to 6 of this chapter, benefit from a time savings account subject to the provisions ofarticle R. 6152-14.

This account is opened by the head of the establishment who, at the beginning of each year, informs the practitioner holding the account of the rights saved and consumed at the end of the previous calendar year and asks him/her to indicate, by 31 March at the latest, his/her choice of use of the days saved.

The time savings account is credited by the carry-over of days of leave, reduced working hours or time off which could not be taken, under the following conditions: 1° Carrying over annual leave, with the number of days taken in any one year not being less than twenty; this limit is reduced in proportion to the length of service of the staff concerned when they are not working full time;…

The request to exercise all or part of the right to leave acquired under the time savings account may only be refused on the grounds of the requirements of the service. Such refusal may not, however, deprive the person concerned of his rights to the benefit of the time saved. In particular, no refusal may be made when the time saved is equal to or greater than the time remaining…

When, at the end of the calendar year, the number of days registered in the time savings account is less than or equal to a threshold set by joint order of the ministers responsible for health, the civil service and the budget, the practitioner may only use the rights thus saved in the form of leave. The threshold mentioned in the previous paragraph may not exceed twenty days.

When, at the end of the calendar year, the number of days registered in the time savings account exceeds the threshold mentioned in article R. 6152-807-1, the practitioner may opt, for the days exceeding this threshold and in the proportions he wishes: 1° For compensation under the conditions set out in article R. 6152-807-3; 2° For the time savings account to be maintained under the conditions set out in article…

Each day concerned by the option mentioned in 1° of article R. 6152-807-2 is compensated up to an amount set by joint order of the ministers responsible for health, the civil service and the budget. This compensation is not subject to the increases and indexations that may be paid to practitioners working in overseas departments and collectivities.

I. – The days mentioned in 2° of Article R. 6152-807-2 are maintained on the time savings account subject to the cumulative conditions listed in 1° and 2° below: 1° The annual increase in the number of days registered above the threshold mentioned in article R. 6152-807-1 does not exceed a ceiling set by a joint order of the ministers in charge of health, the civil service and the budget….

Leave taken under the time savings account is treated as a period of employment and paid as such.

The practitioner retains the rights he has acquired under the time savings account: 1° In the event of a transfer, a change of status to occupy functions covered by the provisions of sections 1, 3, 4, 5 and 6 of this chapter or, for practitioners covered by section 1 of the same chapter, in the event of a secondment or placement seeking an assignment with the national management centre, the…
