Subsection 7: Non-competition arrangements in the event of temporary or permanent departure

The decision by which the director of the hospital grouping’s support establishment sets the conditions for implementing the ban on practice in accordance with the second paragraph of I of article L. 6152-5-1 is brought to the attention of all the practitioners concerned by any appropriate means.

Any practitioner who temporarily or permanently ceases his duties and who intends to carry out a paid activity in a private for-profit health establishment, a private practice, a medical biology laboratory or a pharmacy shall inform the director of the establishment in which he is or was principally practising, in writing, at least two months before the commencement of this activity.

When the director of the establishment in which the practitioner was principally practising finds that the prohibition mentioned in I of article L. 6152-5-1 has not been complied with, a summons is sent to the practitioner’s place of practice at least fifteen days before the date of the interview by registered letter with acknowledgement of receipt.
