Subsection 2: Control and prohibition of collective water misting systems

As part of his supervisory duties, the Director General of the Regional Health Agency may check that the provisions of subsection 1 are being implemented, and may ask the operator to provide evidence that these provisions are being complied with.

If the Prefect, on receipt of a referral from the Director General of the Regional Health Agency, considers that one of the requirements resulting from articles R. 1335-16 to R. 1335-20 has not been complied with, he shall give formal notice to the operator, by any means capable of giving a date certain to the notification of this formal notice, to take preventive or corrective measures within a specified period….

The costs of monitoring the water quality of the systems, particularly when the monitoring is carried out following the reporting of one or more cases of legionellosis potentially linked to the system, are borne by the operator of the collective water misting system.
