The seats are allocated to the employee trade union organisations mentioned in 1° of article L. 23-112-1 in proportion to the results obtained in application of article R. 23-112-2 according to the highest average rule.

In the event of a tie between two or more organisations after application of Article R. 23-112-3, the seat is awarded to the employee trade union organisation that received the most votes in the professional and territorial area of competence of the committee. When the number of votes cast in the professional and territorial area of competence of a committee is less than twice the number of seats to be filled for this committee, the votes cast at national level in this professional area of competence are taken into account for the allocation of seats.
