The seats are allocated to the professional employers’ organisations mentioned in 2° of article L. 23-112-1 in proportion to the results obtained in application of article R. 23-112-6 according to the highest average rule.

In the event of a tie between two or more organisations after application of article R. 23-112-7, the seat is awarded to the professional employers’ organisation with the largest number of member companies in the professional and territorial area of competence of the committee. When the number of member undertakings retained in the professional and territorial area of competence of a commission is less than twice the number of seats to be filled for this commission, the member undertakings retained at national level in this professional area of competence are taken into account for the allocation of seats.
