Subsection 7: Operating grant

The annual surplus from the operating budget may be transferred to the budget for social and cultural activities in accordance with article L. 2315-61, up to a limit of 10% of this surplus. In the absence of an agreement between the central committee and the works councils provided for in Article L. 2315-62 and in the absence of stipulations in the branch collective agreement, the court of first instance sets the amount of the operating subsidy that each works council must retrocede to the central committee with a view to constituting the latter’s operating budget.
