Subsection 2: Appointment of the radiation protection advisor

The employer shall appoint at least one radiation protection advisor to implement the preventive measures and resources provided for in this chapter. This advisor is: 1° Either a natural person, known as a “competent person for radiation protection”, employed by the establishment or, failing that, by the company; 2° Or a legal entity, referred to as a “competent radiation protection organisation”.

I.-In an establishment comprising a basic nuclear installation, the employer shall set up a radiation protection skills centre responsible for advising on radiation protection. I – When the situation and the radiological issues so require, the employer shall ensure continuity of service for the radiation protection advisor. II – When several competent persons in charge of radiation protection are appointed within an establishment, or failing that within the company, they are grouped together within an internal entity with appropriate operating resources.

Where the employer has designated an organisation competent in radiation protection, it shall ensure that the preventive measures implemented under this chapter on the basis of the advice provided in this area by this organisation are coordinated with those it has implemented in respect of other occupational risks.

The competent body for radiation protection and the centre of competence for radiation protection shall include at least one person designated to be responsible for processing the results of the individual dosimetric monitoring of workers provided for in Articles R. 4451-64 et seq.

In companies with fewer than twenty employees, where the risk assessment excludes any risk of internal exposure, the employer may take on the role of competent person for radiation protection if he holds the certificate provided for in 1° of Article R. 4451-125.

The employer shall set out in writing the procedures for carrying out the duties of the radiation protection advisor that it has defined. It shall specify the time allocated and the resources made available, in particular those likely to guarantee the confidentiality of data relating to the monitoring of worker exposure as provided for in Articles R. 4451-64 et seq.

The competent person in charge of radiation protection defined in 1° of Article R. 4451-112 may not be discriminated against because of the performance of his/her duties.

The Social and Economic Committee shall be consulted on the organisation set up by the employer to apply the provisions of this section.

The radiation protection advisor appointed by the employer pursuant to Article R. 4451-112 may also be appointed by the person responsible for the nuclear activity pursuant to Article R. 1333-19 of the Public Health Code.
