Article R6153-1-21 of the French Public Health Code
The provisions of article R. 6153-26 relating to availability are applicable to junior doctors.

The provisions of article R. 6153-26 relating to availability are applicable to junior doctors.
Junior doctors authorised to practise medicine, pharmacy or dentistry in a public health establishment on a temporary basis are recruited under a public law contract. They may only be recruited in the event of the absence of a practitioner and are, in the context of this activity, subject to the provisions of articles R. 6152-334 to R. 6152-355, with the exception of 1°, 2° and 8° of article R. 6152-336,…
Junior doctors practising medicine, pharmacy or odontology in a public health establishment on a locum basis are, in the context of this activity, subject to the provisions of articles D. 6152-356 and D. 6152-357.
Junior doctors authorised to practise medicine, pharmacy or dentistry as locums in a private health establishment are recruited under a private law contract and are subject to the provisions of the French Labour Code.
The director of the health establishment in which the replacement is to take place will request authorisation for the replacement from the competent regulatory authority. As soon as he receives the authorisation decision, he immediately informs the director of the establishment to which the junior doctor is assigned.
Replacements are carried out outside the service obligations of the junior doctor and outside the safety breaks from which he benefits under IV of article R. 6153-2.
The junior doctor may not work as a replacement in the entity in which he or she is being hosted as a trainee.
The terms and conditions for the application of this sub-section are specified, unless otherwise stipulated, by joint order of the Ministers of Health and Higher Education and the Minister of Defence.
Notwithstanding article R. 6153-1-28, the terms of application of articles R. 6153-1-22 to D. 6153-1-27 are specified by order of the ministers responsible for health, the economy and the civil service.
