Chapter III: The industrial tribunal

For the application of articles R. 1441-3, R. 1441-6 to R. 1441-7, and R. 1441-18 to the industrial tribunals of Guadeloupe, references to the department, the departmental level and the regional level are replaced by references to Guadeloupe, Saint-Barthélemy and Saint-Martin.

In Saint-Pierre-et-Miquelon, the territorial council may propose to reduce the number of councillors in each section of the industrial tribunal to two employer councillors and two employee councillors.

In Saint-Pierre-et-Miquelon, the High Court of Appeal replaces the Court of Appeal. The court of first instance replaces the judicial court.

In Saint-Pierre-et-Miquelon, the persons authorised to represent the parties in industrial tribunal matters are, in addition to those mentioned in Article R. 1453-2, approved persons.

The provisions of the second and third paragraphs of article R. 1461-1 , article R. 1461-2 and article R. 1457-2 do not apply to Saint-Pierre-et-Miquelon. In this collectivity, the appeal is lodged, investigated and judged according to the rules of ordinary procedure applicable before the High Court of Appeal.

Industrial tribunal members residing in Saint-Martin or Saint-Barthélemy, when called upon to sit on the Basse-Terre industrial tribunal, are reimbursed, when travelling between the seat of the industrial tribunal and their home or usual place of work, their meal and accommodation expenses in accordance with the terms and conditions set out in 1° and 2° of article 3 of decree no. 2006-781 of 3 July 2006, as amended, setting the…
