Subsection 2: Approval of traineeships

The consultation of the Commission nationale de la négociation collective, de l’emploi et de la formation professionnelle (National Commission for Collective Bargaining, Employment and Vocational Training) and the Comité régional de l’emploi, de la formation et de l’orientation professionnelles (Regional Committee for Employment, Vocational Training and Vocational Guidance) provided for in article R. 6341-2 concerns the programmes under which the courses for which approval is sought are organised.

Courses other than those mentioned in article R. 6341-2 are approved by the President of the Regional Council after consulting the Regional Committee for Employment, Training and Vocational Guidance.

The administrative authority responsible for granting approval shall examine the training course project in accordance with the following assessment criteria: 1° The nature of the training course; 2° The conditions for admission of the trainee; 3° The level of training; 4° The content of the programmes; 5° The content of the training plan provided for in article R. 6341-12; 6° Sanctioning of studies; 7° Qualifications of teachers and those responsible…

The approval decision shall specify: 1° In the case of courses whose duration is defined in advance: a) The maximum number of trainees likely to be remunerated each year; b) The total duration and weekly duration of the course, as well as the number of trainee-months; c) The start and end dates of the course; 2° In the case of courses which receive trainees on a continuous basis: the annual…

Training courses organised by employers in application of article L. 6341-2 may only be approved if they are created as a result of job creation, a change in the production process, a reduction in the workforce or a cessation of activity.

Approval of the training course is granted for a maximum of three years. It may be renewed at the end of the period for which it was issued by an explicit decision.

Approval of the training course may be withdrawn after three months’ notice on the grounds of the results of checks carried out by the bodies or departments responsible for carrying out administrative, financial or technical inspections. Withdrawal of approval does not prevent the persons concerned from continuing to receive their remuneration until the end of the training period.

The agreements referred to in article R. 5111-1 providing for the financing of a training or adaptation programme are deemed to constitute approval of this programme by the State with regard to the remuneration of trainees.

The State public establishment to which the management of remuneration may be entrusted, in application of article L. 6341-6, is a public administrative establishment.
