Section 4: Groups of economic operators and subcontractors

Where the reason for exclusion from the award procedure concerns a member of a grouping of economic operators, the purchaser shall require him to be replaced by another economic operator who is not the subject of a reason for exclusion, within ten days of receipt of this request by the grouping’s representative, failing which the grouping shall be excluded from the procedure.

When a subcontractor against whom grounds for exclusion exist is presented at the stage of the procedure for the award of a contract, the purchaser shall require him to be replaced by another economic operator who is not the subject of grounds for exclusion, within ten days of receipt of this request by the candidate or tenderer, failing which he shall be excluded from the procedure.
