Chapter II: Contracts awarded without prior publication or competitive tendering

Article L2322-1 of the French Public procurement code

The purchaser may award a defence or security contract without prior advertising or competitive tendering in the cases laid down by regulation when, due in particular to the existence of an unsuccessful initial procedure, particular urgency, its subject or estimated value, compliance with such a procedure is unnecessary, impossible or manifestly contrary to the interests of the purchaser or to a reason in the general interest.
