Section 3: Other contracts

The rules laid down in Title II shall apply to public service contracts concluded with a purchaser subject to this Part where the latter enjoys an exclusive right by virtue of a provision adopted by law, provided that this provision is compatible with the Treaty on the Functioning of the European Union.

The following public contracts are subject to the same rules: 1° Services relating to the acquisition or rental, by whatever financial means, of land, existing buildings or other immovable property, or relating to other rights over such property; 2° Services relating to research and development for which the purchaser does not acquire exclusive ownership of the results or does not entirely finance the service.
