Chapter VI: Special rules for the award of certain concession contracts

The specific procurement rules for certain contracts by virtue of their subject matter or whether or not their estimated value excluding tax is below the European threshold set out in the notice annexed to this code are laid down by decree in the Conseil d’Etat.

Notwithstanding the provisions of article L. 3122-2, the conceding authority is not required to record the stages of the procedure for awarding concession contracts mentioned in article L. 3126-1.

Without prejudice to the provisions of Regulation (EC) No 1370/2007 of the European Parliament and of the Council of 23 October 2007 on public passenger transport services by rail and by road, as amended, concession contracts, with the exception of those relating to passenger transport by rail mentioned in Chapter I of Title II of Book I of Part Two of the Transport Code covered by Article 5(3) thereof, are…
