Section 3: Choice of offer

In order to award the concession contract, the conceding authority will, in accordance with the provisions of article L. 3124-5, base itself on a number of non-discriminatory criteria. These criteria may include environmental, social and innovation criteria. The criteria and their description are indicated in the concession notice, in the invitation to submit a tender or in any other consultation document.

The awarding authority sets the award criteria in descending order of importance. The ranking of the criteria is indicated in the concession notice, in the invitation to submit a tender or in any other consultation document. Tenders that have not been eliminated pursuant to article L. 3124-2 are ranked in descending order on the basis of the criteria set out in articles R. 3124-4 and R. 3124-5. The highest-ranked tender is selected.
