Subsection 2: Information to be provided by the candidate

At the latest before the contract is awarded, the candidate must produce any document certifying that it has not been excluded from participating in the procedure for awarding concession contracts provided for in articles L. 3123-1 to L. 3123-14.

To prove that it has fulfilled the obligations set out in article L. 3123-2, the candidate shall produce a certificate issued by the competent administrations and bodies. The list of taxes, levies, contributions or social security contributions for which a certificate must be issued and the list of competent administrations and bodies are set out in an order of the Minister for the Economy appended to this code.

If the candidate relies on the capacities and abilities of other economic operators, it must provide evidence of the capacities and abilities of these economic operators and prove that it will have them throughout the performance of the contract.
