The purchaser who decides to use an electronic auction shall mention this in the contract notice.
The provisions of articles R. 2162-59 to R. 2162-61 apply.
Where the choice of the successful tenderer is not based solely on the criterion of price, the invitation sent to each tenderer shall be accompanied by the result of the full evaluation of its tender carried out in application of article R. 2162-60. The provisions of articles R. 2162-63 to R. 2162-65 apply.
After the closure of the electronic auction, the contract shall be awarded on the basis of the results of that auction, subject to compliance with the provisions of Section 2 of Chapter II of Title V.
