Subsection 3: Variants

Where the purchaser awards the contract on the basis of several criteria, he may authorise the presentation of variants under the following conditions:1° For contracts awarded in accordance with a formalised procedure, variants are prohibited unless otherwise stated in the invitation to tender;2° For contracts awarded in accordance with an adapted procedure, variants are authorised unless otherwise stated in the consultation documents.

Where the purchaser expressly authorises the presentation of variants, he shall state in the consultation documents the minimum requirements that the variants must meet and any special conditions for their presentation.

The provisions of article R. 2151-11 apply.
