Subsection 1: Provisions applicable to the State, its public establishments and unauthorised purchasers

A partnership contract may only be signed by the State with the agreement of the ministers responsible for the budget and the economy.Their agreement is deemed to have been reached in the absence of an express response within one month of receipt of the draft partnership contract.

A partnership contract may only be signed for a public establishment of the State with the agreement of the ministers responsible for the budget and the economy and the minister responsible for the establishment.The agreement of each of these ministers is deemed to have been given if no response is received within one month of receipt of the draft partnership contract.

Where the procedure for awarding a partnership contract has been launched on behalf of an unauthorised purchaser, the contract may only be signed with the express agreement of the ministers responsible for the budget and the economy.
