Subsection 1: Conduct of the competition

The purchaser shall publish a design contest notice under the conditions set out in articles R. 2131-12, R. 2131-13 and R. 2131-16 to R. 2131-20. If the purchaser intends to award a service contract to the winner or one of the winners of the design contest in application of article R. 2122-6, it must indicate this in the contest notice.

Where the design contest is restricted, the purchaser shall establish criteria for selecting the participants in the contest. The number of candidates invited to take part in the design contest shall be sufficient to ensure genuine competition.In the light of the jury’s opinion, the purchaser shall draw up the list of candidates admitted to the contest and the candidates not selected shall be informed thereof.

To organise the competition, the purchaser shall involve a jury composed in accordance with the procedures set out in sub-section 2.

After analysing the applications and giving its reasoned opinion on them, the jury examines the plans and projects submitted anonymously by the economic operators admitted to take part in the competition, on the basis of the evaluation criteria defined in the competition notice.It records in minutes, signed by its members, the ranking of the projects as well as its observations and, where appropriate, any points requiring clarification and the questions…

The purchaser chooses the winner or winners of the competition on the basis of the jury’s minutes and opinion and publishes a notice of the results of the competition under the conditions set out in articles R. 2183-1 to R. 2183-7.

A bonus is awarded to participants who have submitted services that comply with the competition rules. Subject to the provisions of articles R. 2172-4 to R. 2172-6, the amount of the bonus is freely determined by the purchaser and is indicated in the consultation documents.

When a service contract is awarded to the winner or one of the winners of the competition, his remuneration takes account of the premium he received for taking part in the competition.
