Paragraph 2: Public health establishments, public medico-social establishments, health cooperation groups, social and medico-social cooperation groups with legal personality under public law and army hospitals

In the absence of an organisation based on poles of activity, the internal use pharmacy of a public health establishment may be managed by a pharmacist belonging to another health establishment or to an army hospital with which the public health establishment enters into an agreement for this purpose.

In the public medico-social establishments mentioned in 3° of article R. 5126-1, the internal use pharmacy is managed by a pharmacist belonging to one of the categories of practitioners mentioned in 1° of article L. 6152-1 or by a pharmacist recruited for this purpose under a public law contract.

In public health cooperative groups and social and medico-social cooperative groups, the management of the pharmacy for internal use is entrusted to one of the pharmacists made available to the group by the establishments which are members of it. Of the pharmacists made available by a public health establishment, only the practitioners mentioned in 1° of article L. 6152-1 may manage the pharmacy.

I-Pharmacists appointed as managers or heads of department of a pharmacy for internal use by decision of the Minister of Defence are responsible for the management of pharmacies for internal use in army hospitals. Pharmacists who manage a pharmacy for internal use in a prison must have been personally authorised to do so under the conditions set out in article D. 386 of the Code of Criminal Procedure.

Subject to the provisions of article R. 5126-46, the pharmacist responsible for managing the internal use pharmacy is appointed by the legal representative of the managing legal entity. In the case of public health establishments, this appointment results from the appointment of the pharmacist to one of the positions mentioned in article R. 5126-42.
