Subsection 3: Certificate of conformity

The form entitled “Certificate of conformity” conforms to a model laid down by order of the minister responsible for the economy.

The certificate of conformity is sent by the beneficiary of the authorisation to the prefect, by electronic means. The certificate of conformity is dated and signed by the body that drew it up.

If the authorised project is completed or marketed in stages, a certificate is drawn up for each stage, in proportion to each completion or marketing, within the limit of the period of validity of the commercial development authorisation as set out in article R. 752-20. If the retail facility created has a smaller sales area or footprint and number of lanes than that authorised under the second paragraph of article L. 752-15 and article L. 752-16, a certificate is issued for the part of the project that has been completed. The provisions of the second paragraph of article R. 752-44-10 are applicable.

The certificate of conformity may not be subject to reservations. Where applicable, it shall mention the differences noted with the commercial operating permit, which may not be substantial within the meaning of article L. 752-15. Reasons must be given for any refusal to certify.

The prefect immediately sends the certificate of conformity by electronic means for information to the mayor of the commune in which the site is located and to the president of the public inter-communal cooperation establishment with its own tax system of which the commune in which the site is located is a member.
