Section 2: Collective marks

A collective mark is a mark so designated when filed and capable of distinguishing the goods or services of persons authorized to use it under its rules of use. The provisions of this Book shall apply to collective marks subject to the special provisions set out in this Section.

Any association or group with legal personality representing manufacturers, producers, service providers or traders, as well as any legal person governed by public law, may apply for registration of a collective mark. A collective mark may only be assigned or transferred to a legal entity meeting the conditions set out in the first paragraph of article L. 715-7.
