Subsection 1: Judgment on liability

The judgment recognising the defendant’s liability shall set the period within which the defendant must implement the publicity measures ordered pursuant to the article 67 de la loi du 18 novembre 2016 aforementioned and, failing this, on expiry of which they will be carried out by the plaintiff in the action at the defendant’s expense.

The judgment recognising the defendant’s liability shall specify whether the individual reparation procedure or the collective procedure for the liquidation of damages is applied.

The information measures ordered by the judge shall include, in addition to any particulars prescribed by the judgment: 1° A reproduction of the operative part of the decision; 2° Depending on whether the collective winding-up procedure or the individual compensation procedure is applied, the contact details of the party or parties to whom each interested party may address their claim for compensation; > The form and content of the claim…
