Section 1: Failure by the foreign national to cooperate and enforce the removal order

A foreigner is liable to three years’ imprisonment if he fails to present to the competent administrative authority the travel documents required to enforce an administrative ban on entry, a decision to expel, a measure to escort to the border or an obligation to leave French territory or, in the absence of such documents, fails to provide the information required for enforcement or provides inaccurate information about his identity.

It is a punishable offence under Article L. 822-1 for a foreign national who is the subject of a decision to be removed from French territory to refuse to submit to fingerprinting and photographing operations in the cases provided for in 3° and 4° of Article L. 142-1.

It is punishable by one year’s imprisonment and a fine of €3,750 for a foreign national to remain illegally on French territory without a legitimate reason, after having been the subject of a lawful detention order or house arrest order that has ended without it having been possible to remove him or her in execution of an administrative ban from French territory, an obligation to leave French territory, a decision…
