Section 2: Foreign nationals placed under a protection order

A foreign national who has been granted a protection order under article 515-9 of the French Civil Code, due to violence within the couple or by a former spouse, a former partner in a civil solidarity pact or a former cohabitee, will be issued with a one-year temporary residence permit for “private and family life” as soon as possible. The condition set out in article L. 412-1 does not apply.

The residence permit provided for in article L. 425-6 is issued, under the same conditions, to a foreign national who benefits from a protection order pursuant to article 515-13 of the Civil Code due to the threat of a forced marriage.

In the event of the defendant’s final conviction, a foreign national holding a residence permit under articles L. 425-6 and L. 425-7 who have lodged a complaint for acts of violence committed against them by their spouse, cohabitee or partner to whom they are bound by a civil solidarity pact, or for acts of violence committed against them due to their refusal to enter into a marriage or union or…
