Section 3: Rights guaranteed to foreign nationals during legal proceedings

On receipt of the request for extension, the court clerk will notify the foreign national of his or her right to choose a lawyer. The liberty and custody judge will have one appointed for him/her ex officio if the foreign national so requests.

When the foreign national is held at the disposal of the courts, the public prosecutor decides on the conditions of the holding. He shall inform the foreign national and the administrative authority that ordered the detention without delay.
