Section 2: Decisions that may be taken during the period of voluntary departure

The administrative authority competent to designate, pursuant to article L. 721-6, a foreign national’s place of residence is the département prefect and, in Paris, the police prefect.

The administrative authority competent to require a foreign national to comply with the presentation requirements laid down in article L. 721-7 is the département prefect and, in Paris, the police prefect.

For the application of article L. 721-7, the administrative authority shall designate the department to which the foreign national shall make the prescribed introductions and shall determine their frequency, which may not exceed three introductions per week.

When the administrative authority requires the foreign national to surrender his or her passport or any identity or travel document in his or her possession, pursuant to article L. 721-8, it shall in exchange issue the foreign national with a receipt equivalent to proof of identity.The time limit granted to the foreign national for his or her departure shall, where appropriate, be noted on this receipt.
