Subsection 2: Transfer to another Member State of the European Union

A beneficiary of temporary protection in France may apply to join a family member who is benefiting from temporary protection in another Member State of the European Union. The prefect of the département and, in Paris, the prefect of the police then notifies the competent authorities of that State in writing with a view to transferring the person concerned to the territory of that State.

The préfet de département and, in Paris, the préfet de police may refer the matter to another EU Member State for the purposes of transferring a foreign national who is a beneficiary of temporary protection in France to the territory of that State. In the event of a beneficiary of temporary protection being transferred to another Member State of the European Union pursuant to article R. 581-13 or R. 581-14, the temporary residence permit issued on the basis of article R. 581-4 is withdrawn. France’s temporary protection obligations towards the person concerned are also terminated.
