The asylum seeker’s allowance, provided for in Article L. 553-1, is due from the time of acceptance of the material reception conditions. It is allocated to asylum seekers for the period set out in article L. 551-13.

To qualify for the asylum seeker’s allowance provided for in article L. 553-1, the asylum seeker must be at least eighteen years old and have monthly resources below the amount of the active solidarity income.The resources taken into consideration for the application of the first paragraph include those of the person concerned and, where applicable, their spouse, partner linked by a civil solidarity pact or cohabiting partner. The following resources are not taken into account when determining entitlement to the asylum seeker’s allowance:1° Family benefits;2° Insurance or solidarity allowances, work placement remuneration and income from employment received during the reference period, where it is proven that receipt of these allowances, remuneration and income has been definitively interrupted at the date of the application and that the recipient of these resources is not entitled to a substitute income.

Alimony or compensatory allowance fixed by a court decision that has become enforceable, a divorce or legal separation agreement by mutual consent provided for in article 229-1 of the Civil Code, by a deed received in authentic form by a notary or by a court-approved agreement is deducted from the resources of the person paying it.

The means test provided for in article L. 553-1 may be subject to subsequent review by the French Office for Immigration and Integration.
