Section 4: Rights guaranteed to foreign nationals during legal proceedings

On receipt of the application for extension, the court clerk notifies the foreign national of his or her right to choose a lawyer. If the foreign national so requests, the judge will have one appointed for him/her ex officio.

When the foreign national is held at the disposal of the courts, the public prosecutor decides on the conditions of the holding. He shall inform the foreign national and the administrative authority that ordered the foreign national to be held in the waiting area of this without delay.
