Section 1: General provisions

The departmental prefect and, in Paris, the police prefect, have jurisdiction over the entry and residence of foreign nationals and the right of asylum under the conditions defined in articles 11-1 and 71 of decree no. 2004-374 of 29 April 2004 on the powers of prefects and the organisation and action of State services in the regions and departments.

The issue of visas to foreigners falls within the remit of heads of consular posts and heads of diplomatic missions under the conditions set out in Decree no. 2008-1176 of 13 November 2008 on the powers of heads of diplomatic missions and heads of consular posts with regard to visas.
