Article 1034 of the French Code of civil procedure

Unless the case has been referred to the referring court without prior notification, the statement must, on pain of inadmissibility being raised of its own motion, be made before the expiry of a period of two months from the date of notification of the judgment of cassation to the party. This time limit shall run even against the party giving notice.

The absence of a declaration within the time limit or its inadmissibility confers the force of res judicata on the judgment rendered at first instance where the decision quashed had been rendered on appeal from that judgment.

A moins que la juridiction de renvoi n’ait été saisie sans notification préalable, la déclaration doit, à peine d’irrecevabilité relevée d’office, être faite avant l’expiration d’un délai de deux mois à compter de la notification de l’arrêt de cassation faite à la partie. Ce délai court même à l’encontre de celui qui notifie.

L’absence de déclaration dans le délai ou l’irrecevabilité de celle-ci confère force de chose jugée au jugement rendu en premier ressort lorsque la décision cassée avait été rendue sur appel de ce jugement.
