I. – Subject to the provisions of I of Article 257, real estate acquisitions made out of court and for valuable consideration by communes or syndicates of communes, public land establishments created pursuant to Articles L. 324-1 et seq. of the town planning code, departments, regions and by communal, departmental or regional public establishments do not give rise to any collection for the benefit of the Treasury.
The same applies to acquisitions of businesses made by the local authorities or public establishments mentioned in the first paragraph within the framework of articles L. 2251-1 to L. 2251-4, L. 2253-1, L. 3231-1, L. 3231-6, L. 3232-4, and the 5°, 6°, 7° and 8° of article L. 4211-1 du code général des collectivités territoriales, provided that the resolution of the authority competent to decide on the transaction refers to the legislative provisions in question and is appended to the deed.
II. – Acquisitions of shares made by communes, départements, regions and their groupings under article L. 1522-1 du code général des collectivités territoriales ne donnent lieu à aucune perception au profit du Trésor, sous réserve que la décision de l’assemblée délibérante compétente pour décider de l’opération fait référence à la disposition législative en cause et soit annexée à l’acte.
III. – Subject to I of Article 257, acquisitions made out of court and for valuable consideration of state-owned property recognised as useless by the Minister of Defence and having benefited from the scheme provided for in Article 67 of Finance Act no. 2008-1425 of 27 December 2008 for 2009, on the one hand, by local public companies created pursuant to Article L. 1531-1 du code général des collectivités territoriales and, secondly, by sociétés publiques locales d’aménagement created pursuant to article L. 327-2 of the town planning code or by local public development companies of national interest created pursuant to article L. 327-3 of the same code, insofar as these companies are acting as concessionaires for the development operation, do not give rise to any collection for the benefit of the Treasury.
