Article 1046-1 of the French Code of civil procedure

The Public Prosecutor with territorial jurisdiction shall give instructions to the custodians of the registers of the erroneous or annulled document, as well as to those holding the other documents affected by the same error or drawn up following the erroneous or annulled document.

The Public Prosecutor shall inform the person to whom the document relates, his or her legal representative(s) or the person responsible for his or her protection within the meaning of Article 425 of the Civil Code of the rectification or cancellation of the document. This information is not required if the document was drawn up in duplicate by mistake.

Le procureur de la République territorialement compétent donne instructions aux dépositaires des registres de l’acte erroné ou annulé, ainsi qu’à ceux qui détiennent les autres actes entachés par la même erreur ou dressés à la suite de l’acte erroné ou annulé.


Le procureur de la République informe de la rectification ou de l’annulation de l’acte, la personne à laquelle l’acte se rapporte, son ou ses représentants légaux ou la personne chargée de sa protection au sens de l’article 425 du code civil. Cette information n’est pas requise lorsque l’acte a été établi, par erreur, en double.
